Falcata Run, Falcata Analyzer (macOS), and the Falcata Run web video analyzer · Effective date: June 14, 2026
These Terms of Use ("Terms") govern your access to and use of Falcata Run, including the Falcata Analyzer macOS application, the Falcata Run web video analyzer, Falcatarun.com, and any related software, features, exports, documentation, or services we provide (collectively, the "App").
By accessing or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Purpose of Falcata Run
Falcata Run is a sports performance analysis tool designed to help athletes, coaches, trainers, and related sports professionals review sprinting technique, running form, ground contact, timing, markers, overlays, and related performance information.
The App is intended for analyzing videos of athletes where the user has the necessary rights, permission, consent, or lawful basis to use the video for coaching, training, or performance review.
Falcata Run is not a general-purpose video editor, media publishing platform, social media tool, or tool for republishing third-party footage.
2. Not a scientific, medical, or diagnostic tool
Falcata Run is a coaching and training-support tool. It is developed to help athletes, coaches, and trainers review sprinting form and technique using video analysis, user-placed markers, timing calculations, publicly available biomechanics concepts, and general principles of physics.
Falcata Run is not a professional scientific instrument, laboratory-tested measurement system, certified timing system, medical device, diagnostic tool, rehabilitation device, injury assessment tool, or substitute for professional medical, biomechanical, sports science, or coaching judgment.
The App has not been validated for medical diagnosis, injury detection, injury prevention, rehabilitation decisions, clinical use, official competition timing, athlete selection, or any other high-stakes purpose.
You must not use Falcata Run to diagnose, treat, monitor, predict, or assess any medical condition, injury, disease, pain, movement disorder, impairment, or health-related issue. Any health, injury, pain, rehabilitation, or medical concern should be assessed by a qualified medical professional.
Any measurements, overlays, ground contact time estimates, timing values, charts, CSV exports, or other outputs from the App are approximate and depend on factors such as video quality, frame rate, camera angle, lighting, user input, marker placement, device performance, imported data, and processing assumptions. You are responsible for reviewing and interpreting the results appropriately.
3. Your responsibility for videos and content
You are solely responsible for any video, image, data, file, marker, annotation, export, or other content that you import, upload, analyze, process, save, or export using the App ("User Content").
You represent and warrant that you have all necessary rights, permissions, licenses, consents, and legal authority to use your User Content in the App and to create, save, export, share, or publish any resulting analysis, image, video, CSV file, or other output.
You must not use the App to analyze, edit, export, publish, distribute, or otherwise use videos or other materials in a way that infringes or may infringe the rights of another person or organization, including copyright, trademark, privacy, publicity, image rights, personality rights, contractual rights, competition rules, league rules, broadcast rights, or any other applicable rights.
4. Prohibited use of third-party and professional footage
The App is not intended for analyzing or exporting videos of professional athletes, televised competitions, streamed events, social media clips, copyrighted sports broadcasts, training videos owned by others, or any other third-party footage unless you have the necessary rights, permission, consent, or legal basis to do so.
You must not use Falcata Run to create or distribute analysis videos, screenshots, overlays, or other exports based on professional sports footage, copyrighted videos, or videos of other athletes without proper authorization.
This restriction applies even if the App allows you to technically open, process, annotate, or export the video.
5. Athlete consent and minors
If your User Content includes an identifiable athlete or other person, you are responsible for ensuring that you have any required consent to use that person's image, likeness, performance data, and related information.
If the athlete is a minor, you are responsible for obtaining consent from the athlete's parent, guardian, legal representative, club, school, or other appropriate authority where required.
You are also responsible for complying with any team, club, federation, school, league, employer, or event rules that apply to recording, analyzing, exporting, or sharing athlete videos.
6. Local processing and web use
Where the App provides local analysis features, videos may be processed on your device or in your browser. For example, the web analyzer may allow you to select a local video file and analyze it in the browser without uploading the video to Falcata Run servers.
Local processing does not change your responsibility for the content. You remain solely responsible for ensuring that you have the right to use, analyze, export, and share any video or output.
If a feature requires uploading, syncing, cloud processing, sharing, or storing content through Falcata Run or a third-party provider, additional terms, privacy information, or consent requirements may apply.
7. Exports and watermarks
The App may allow you to export videos, images, CSV files, charts, analysis files, or other outputs. Exported videos or images may include analysis overlays, markers, timing information, ground-contact information, or a label such as "Analysed with Falcatarun.com."
Any Falcata Run label, watermark, or attribution identifies the analysis tool used to generate the overlay or output. It does not mean that Falcata Run owns, licenses, approves, endorses, verifies, or has permission to use the underlying video or footage.
You must not use a Falcata Run watermark, label, logo, or export to suggest that Falcata Run owns the source video, has authorized the video, endorses the athlete, endorses your use of the video, or has approved publication or distribution of the exported content.
8. Not professional medical, legal, or coaching advice
The App provides tools for sports analysis and performance review; it does not provide medical advice, diagnosis, treatment, injury-prevention claims, legal advice, or professional coaching certification.
You are responsible for how you interpret and apply any analysis. Athletes and coaches should use their own judgment and, where appropriate, consult qualified medical, coaching, legal, or sports science professionals.
9. Accuracy and performance data
Falcata Run analysis may depend on video quality, frame rate, camera angle, lighting, user input, marker placement, device performance, imported data, and other factors.
We do not guarantee that any timing, marker, ground contact time, overlay, chart, export, or other analysis output is complete, accurate, reliable, or suitable for competition decisions, official timing, selection decisions, injury assessment, medical use, legal disputes, or other high-stakes purposes.
You are responsible for reviewing and verifying any analysis before relying on it.
10. Your use of the App
You agree not to:
- use the App for unlawful, infringing, deceptive, abusive, or harmful purposes;
- use the App to violate copyright, privacy, publicity, image rights, broadcast rights, or other third-party rights;
- use the App to analyze or export third-party footage without proper authorization;
- misrepresent your rights to any video or content;
- remove, alter, obscure, or misuse Falcata Run branding in a way that is misleading;
- reverse engineer, copy, modify, or redistribute the App except where allowed by law;
- interfere with the security, integrity, or operation of the App;
- use the App to create content that falsely implies endorsement, sponsorship, approval, or affiliation with Falcata Run, an athlete, a team, a league, a broadcaster, or any other third party.
11. Ownership
Falcata Run and its software, design, branding, logos, algorithms, user interface, documentation, and related materials are owned by us or our licensors and are protected by applicable intellectual property laws.
You retain any rights you have in your User Content. We do not claim ownership of your videos or athlete data merely because you use the App to analyze them.
However, you grant us any limited rights necessary to operate the App where applicable. For local-only features, this may not require us to receive or store your content. For cloud, upload, sync, support, or sharing features, additional processing rights may be necessary and may be described in our Privacy Policy or feature-specific notices.
12. Feedback
If you provide feedback, suggestions, bug reports, feature requests, or ideas about the App, you allow us to use them without restriction or compensation to you.
13. Privacy
Our collection and use of personal data is described in our Privacy Policy. You are responsible for ensuring that you have a lawful basis to process any personal data, athlete data, images, videos, or performance information that you use in the App.
If you use the App with athletes, students, minors, clients, team members, or other individuals, you are responsible for providing any required notices and obtaining any required consents.
14. Third-party services
The App may use or link to third-party services, platforms, APIs, operating system features, cloud providers, AI providers, analytics tools, payment providers, or export tools.
We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.
15. Availability and changes
We may modify, suspend, discontinue, update, or limit the App or any feature at any time. We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to notify users where appropriate.
Your continued use of the App after changes become effective means you accept the updated Terms.
16. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, NON-INFRINGEMENT, AVAILABILITY, AND ERROR-FREE OPERATION.
We do not warrant that the App will meet your requirements, that analysis results will be accurate, that exports will be suitable for your intended use, or that the App will operate without interruption or error.
The App is a coaching and training-support tool only and is not a medical device, diagnostic tool, laboratory-tested scientific instrument, or certified timing system. Its outputs are approximate and must not be relied on for diagnosis, treatment, injury assessment, official timing, or other high-stakes decisions.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REPUTATION, BUSINESS OPPORTUNITIES, OR ATHLETIC OPPORTUNITIES ARISING FROM OR RELATED TO YOUR USE OF THE APP.
Because the App is provided free of charge, to the fullest extent permitted by applicable law, our total liability for any claim arising from or related to the App or these Terms will be limited to the maximum extent permitted by applicable law.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that cannot be excluded or limited under applicable law.
Some jurisdictions do not allow certain limitations of liability or the exclusion of certain warranties, so some of the above limitations may not apply to you.
18. Indemnity
You agree to defend, indemnify, and hold harmless Falcata Run, its owners, developers, employees, contractors, partners, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:
- your User Content;
- your use or misuse of the App;
- your exports, publications, or sharing of analyzed content;
- your violation of these Terms;
- your violation of any third-party rights, including copyright, privacy, publicity, image, likeness, broadcast, or contractual rights;
- your failure to obtain required permissions or consents.
19. Termination
We may suspend or terminate your access to the App if we reasonably believe that you have violated these Terms, used the App unlawfully, infringed third-party rights, created legal risk for us or others, or misused the App.
You may stop using the App at any time.
20. Governing law and disputes
These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules.
Any disputes arising from or related to these Terms or the App will be resolved in the competent courts of the Canton of Aargau, Switzerland, unless applicable law requires otherwise.
If you use the App as a consumer, you may have mandatory legal rights under the law of your country of residence — including in the European Union, Switzerland, and the United States — that cannot be waived or limited by agreement. Nothing in these Terms affects those mandatory rights, and the choice of Swiss law does not deprive you of the protection of mandatory provisions of the law of your place of residence.
